Unless specifically placed in the public domain these tunes are protected by copyright. Depending on the country copyright will last more or less long... currently 75 years in the UK IIRC.

If something is in the public domain -- or in the case of the US if you have used "reasonable effort" to find the author and failed, you may use it (although they can later sue if they hadn't released it to the public domain). For instance the Sync tracker contained a public domain Speech Synthesizer on the Atari.

There's also the doctrine of fair use -- sampling one sound is legal, but copying every sound from a tune or Yamaha's latest synthesizer, isn't.

That still doesn't mean you can claim authorship...

In the demo world, we tended to rip each others music but we always credited the author, and as no profit was ever made, there were no issues.

People originally credited 2 bit systems/Quartet for their digital -> analog volume tables, but as time passed, they stopped. TeX had their own tables, as did we (ST-CNX) which we calculated from Yamaha's documentation. (And yes, they did sound different!) Ajarn and I spent a whole day with an oscilloscope but that didn't really bear any fruit.

Ripping code was more interesting: some of us felt it was never OK, others felt it was OK to learn from others as long as they were credited, and some felt it was fine to rip and call it their own... the latter people ended up with poor reputations.

In this case, not only are they being dishonnest, probably breaking the law, but also they sound horrible.
